Terms of Service.

ApotheKitty recommends skincare products across every brand we can source. Although we may receive compensation for partner purchases made through affiliate links on this site, this does not influence our algorithm or our recommendations.

If Product A is a better fit for your skin than Product B, but Product A does not provide us any compensation, we will still recommend Product A — and we will still rank it above Product B. Our ranking logic is driven exclusively by ingredient analysis, published dermatological literature, and independent consumer review consensus.

These Terms of Service ("Terms") are a binding agreement between you and ApotheKitty ("ApotheKitty," "we," "us," or "our") governing your access to and use of the apothekitty.ai website, the skin analysis quiz, our AI-generated recommendations, and any related features (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service. By using it, you represent that you meet this requirement. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

ApotheKitty is a cross-brand skincare intelligence tool. We collect information about your skin through a quiz (optionally including uploaded photos), analyze it with AI models, and surface product recommendations drawn from publicly available ingredient data and consumer reviews. An account is optional; some features may require one.

We may add, change, or remove features at any time, and we may impose limits on usage at our discretion.

You may use the quiz and view recommendations without creating an account. If you do create one, you are responsible for keeping your credentials confidential and for all activity that occurs under your account. Accounts are for a single person; do not share them. Notify us promptly at questions@apothekitty.ai if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being misused.

ApotheKitty is an informational and cosmetic tool. It is not medical advice, diagnosis, or treatment. Our recommendations do not replace consultation with a licensed dermatologist, physician, or other qualified healthcare provider. If you have a persistent skin condition, an acute reaction, a known allergy, are pregnant or nursing, or are taking prescription topicals, consult a professional before using any recommended product. Always patch-test new products and discontinue use if irritation occurs.

Our recommendations are produced by AI models and automated data pipelines. Outputs are probabilistic and may be inaccurate, incomplete, or out of date. Product data (formulations, ingredient lists, availability, and pricing) changes frequently and can differ across regions and retailers. Always read the physical product label before purchasing or applying. We do not guarantee any particular result, improvement, or outcome for your skin.

When you submit quiz answers or upload photos, you represent that you own or have all rights necessary to share them, and that they do not depict minors or other people without their consent. Do not upload sensitive medical records, government identification, financial information, or anyone else's likeness.

You retain ownership of your submissions. You grant ApotheKitty a worldwide, royalty-free, non-exclusive, sublicensable license to host, store, transmit, process, and analyze your submissions solely to (a) deliver and improve the Service, and (b) produce aggregated or de-identified data that no longer identifies you. You can request deletion of your submissions by emailing questions@apothekitty.ai.

Some outbound purchase links are affiliate links (typically to Amazon and other retailers). If you click one and complete a purchase, we may earn a commission at no additional cost to you. Commissions do not affect ranking or which products are shown. Every outbound retail link is disclosed as rel="sponsored" in the HTML per FTC guidance.

Any purchase you make is a transaction directly between you and the retailer. Shipping, returns, warranties, product authenticity, and customer support are solely the retailer's responsibility. We are not a party to those transactions.

The Service references publicly available consumer reviews and content from sources including Amazon, Reddit (including but not limited to r/SkincareAddiction, r/AsianBeauty, and r/30PlusSkincare), RealSelf, and published dermatological literature. That content belongs to its respective owners and is provided "as is" without endorsement of ApotheKitty by those sources, or endorsement of those sources by ApotheKitty.

You agree not to:

• Scrape, crawl, or use automated tools to access the Service beyond what our robots.txt permits;
• Reverse engineer, decompile, or attempt to derive source code or model weights;
• Resell, sublicense, or commercially redistribute recommendations or outputs;
• Upload unlawful, infringing, harassing, deceptive, or malicious content;
• Interfere with, disrupt, or attempt to bypass rate limits, security, or authentication;
• Use the Service to build a competing product or train a competing model.

The Service — including its name, logo, design, code, editorial content, and recommendation algorithms — is owned by ApotheKitty and protected by copyright, trademark, and other laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial purposes. If you send us feedback or suggestions, you agree we may use them without obligation to you.

If you believe content on the Service infringes your copyright, send a notice to questions@apothekitty.ai that includes the elements required by 17 U.S.C. § 512(c)(3): your signature, identification of the copyrighted work, identification of the allegedly infringing material with enough detail to locate it, your contact information, a good-faith statement that use is not authorized, and a statement under penalty of perjury that the notice is accurate and that you are authorized to act.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, APOTHEKITTY DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT ANY OUTCOME, RESULT, OR IMPROVEMENT TO YOUR SKIN.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APOTHEKITTY AND ITS OWNERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

You agree to defend, indemnify, and hold harmless ApotheKitty and its owners, employees, and affiliates from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use or misuse of the Service, (b) your submissions, or (c) your violation of these Terms or of any law or third-party right.

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including suspected violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.

We may modify the Service or these Terms at any time. Material changes to the Terms will be reflected by updating the "Last updated" date above and, where appropriate, by additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Before filing any claim, you agree to first contact us at questions@apothekitty.ai and attempt to resolve the dispute informally for at least sixty (60) days. If the dispute is not resolved, you and ApotheKitty agree that any lawsuit will be filed exclusively in the state or federal courts located in King County, Washington, and each party consents to personal jurisdiction and venue there.

These Terms, together with the Privacy Policy and any other policies referenced here, are the entire agreement between you and ApotheKitty regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. We may provide notices by email or by posting on the Service.
